1. (a) The owner or operator to whom a temporary permit was issued may request a reissuance of the temporary permit for a period not to exceed one year, provided that at least one of the following is met:

   1. (1) Actual construction has been completed by the expiration date, but any required compliance testing has not been completed;
   2. (2) Actual construction has commenced by the expiration date but has not been completed;
   3. (3) Actual construction has not commenced, but the owner or operator provides a copy of at least one binding agreement or contractual obligation which cannot be canceled or modified without substantial loss to the owner or operator;
   4. (4) The owner or operator is in the process of obtaining a permit or other authorization required for the project from another governmental entity; or
   5. (5) The owner or operator is involved in litigation where a decision regarding a permit or other authorization required for the project from another governmental entity has been issued and appealed.
2. (b) To obtain a reissuance, the owner or operator shall file a written request for a reissuance that specifies the basis for the request and includes a certification as specified in Env-A 605.04(c).
