1. (a) The expiration date of each temporary permit shall be 18 months after the date of its issuance.
2. (b) The temporary permit shall be in effect until the designated expiration date, unless revoked or suspended at an earlier date by the department pursuant to RSA 125-C:13.
3. (c) Unless reissued in accordance with Env-A 607.09, a temporary permit shall expire on the expiration date listed on the temporary permit.
4. (d) Except as provided in (e), below, the expiration of a temporary permit shall terminate the authority of the owner or operator to construct or operate a new or modified source or device pursuant to the permit.

5. (e) Pursuant to RSA 541-A:30, I, the authority of the owner or operator to construct or operate a new or modified source or device shall continue, subject to the terms and conditions of a temporary permit that otherwise would have expired, pending the department’s decision on:

   1. (1) A timely and complete application for reissuance of the temporary permit, as specified in Env-A 607.09, if the owner or operator demonstrates that any of the circumstances listed in Env-A 607.09(a)(1)-(5) apply; or
   2. (2) A timely and complete application for a state permit to operate or amendment thereto, or a title V operating permit or amendment thereto.
