1. (a) For an initial temporary permit, an application shall be considered timely if it is filed with the department prior to the construction or installation of a new or modified source or device.
2. (b) For the reissuance of a temporary permit, an application shall be considered timely if it is filed with the department at least 90 days prior to the designated expiration date of the temporary permit.
