“Owner or operator” means, for the purpose of this chapter, any person who:

1. (a) Owns, leases, operates, controls, or supervises a facility, building, structure, or installation which directly or indirectly results or may result in emissions of CO2 from a CO2 budget source; or
2. (b) Purchases power from a CO2 budget unit under a life-of-the-unit contractual arrangement in which the purchaser controls the dispatch of the power from the unit.
