1. (a) The owner or operator of a gas-fired or oil-fired unit using the low mass emissions excepted methodology under 40 CFR 75.19 shall comply with the following:

   1. (1) The applicable general operating requirements of 40 CFR 75.10;
   2. (2) The applicable requirements of 40 CFR 75.19; and
   3. (3) The applicable certification requirements of this part.

2. (b) The excepted methodology pursuant to (a), above, shall be deemed provisionally certified for use under this chapter, as of the following dates:

   1. (1) For units that are reporting on an annual basis, January 1 of the year following submission of the certification application for approval to use the low mass emissions excepted methodology under 40 CFR 75.19 until the completion of the period for the department review; and

   2. (2) For units that are reporting on a control period basis:

      1. a. For a unit that commenced operation before its compliance deadline, where the certification application is submitted before May 1, May 1 of the year of the submission of the certification application for approval to use the low mass emissions excepted methodology under 40 CFR 75.19 until the completion of the period for the department review; or
      2. b. For a unit that commenced operation before its compliance deadline, where the certification application is submitted after May 1, May 1 of the year following submission of the certification application for approval to use the low mass emissions excepted methodology under 40 CFR 75.19 until the completion of the period for the department review.
