1. (a) NOx DERs may be used anywhere within New Hampshire, subject to Env-A 3105.02 and Env-A 3108, if they were generated in New England, except in areas that receive a NOx waiver from EPA pursuant to section 182(f) of the Act, with no additional ratio applied.

2. (b) VOC DERs may only be used, subject to Env-A 3105.02 and Env-A 3108:

   1. (1) Anywhere within New Hampshire if they were generated in New Hampshire; or

   2. (2) In:

      1. a. The New Hampshire portion of the Serious Nonattainment Boston-Lawrence-Worcester Consolidated Metropolitan Statistical Area only if they were generated in the Serious Nonattainment Boston-Lawrence-Worcester Consolidated Metropolitan Statistical Area;
      2. b. In Coos, Grafton, or Carroll Counties if they were generated within New England and outside of New Hampshire; or
      3. c. In Belknap, Cheshire, or Sullivan Counties if they were generated within New England, outside of New Hampshire, and inside a nonattainment area.
