An individual who has established a benefit year pursuant to RSA 282-A:4 shall not be eligible to receive benefits in the individual's next benefit year unless:

1. (a) The individual has earned at least $700 of wages during or subsequent to the established benefit year; and

2. (b) The wages were earned:

   1. (1) In employment as defined in RSA 282-A:9;
   2. (2) For services in a state other than New Hampshire which if such services had been performed in New Hampshire would have been employment as defined in RSA 282-A:9; or
   3. (3) For services as described at RSA 282-A:9, IV(f) even though otherwise excluded from employment in RSA 282-A:9.
