1. (a) Under the provisions of RSA 541-A:16, I(d), submission of a petition for a declaratory ruling, as defined at RSA 541-A:1,V, shall be in writing to the commissioner and contain the following:

   1. (1) A complete statement of the facts relating to the issues;
   2. (2) The full names and addresses and, if applicable, social security numbers and department of employment security employer numbers, of all parties;
   3. (3) True copies of all contracts, deeds, agreements, instruments and other documents involved in the issues;
   4. (4) Reference to the statute or statutes relating to the subject of the petition for declaratory ruling;

   5. (5) A statement whether, to the best of the petitioner's knowledge the issues which are the subject of the petition are:

      1. a. The subject of an administrative appeal, or pending in litigation;
      2. b. The subject of a decision which has become final;
      3. c. As regards to a prior time period, the subject of an administrative appeal, pending in litigation or the subject of a decision which has become final; and
      4. d. Whether there are, have been, or will be similarly-situated individuals, partnerships or corporations and if known, who they are.

2. (b) A petition for declaratory ruling and any factual information submitted therewith shall be accompanied by a declaration in the following form:

   “I declare that I have examined this petition, including accompanying documents, and to the best of my knowledge and belief, the facts presented in support of the requested declaratory ruling are true, correct, and complete.”
