1. (a) For purposes of evaluating whether a child has a specific learning disability, one or more of the following criteria shall be used:

   1. (1) A discrepancy model between intellectual skills and achievements;
   2. (2) A process that determines if the child responds to scientific, research-based intervention as part of the evaluation procedures described in 34 CFR 300.307(a)(2); and
   3. (3) Other alternative research-based procedures as described in 34 CFR 300.307(a)(3).
2. (b) Each LEA shall adopt a policy describing the evaluation procedures and standards that will be used to evaluate whether a child has a specific learning disability.
