If any party to whom notice has been given in accordance with Ec-Wtr 203.14(b) fails to attend a hearing, the presiding officer shall declare the party to be in default and shall either:

1. (a) Dismiss the appeal, if the party with the burden of proof fails to appear; or
2. (b) Hear the testimony and receive evidence offered by any party with burden of proof in the case.
