The presiding officer shall, upon the presiding officer’s own initiative or upon request by any party, waive the application of any rule in this chapter upon reasonable notice to all affected persons if the presiding officer determines that such waiver:

1. (a) Would not violate any applicable statutory or constitutional requirement;
2. (b) Would not unduly prejudice any party; and
3. (c) Would be more likely to promote the fair, accurate, and efficient resolution of an issue pending before the council than would adherence to the rule.
