The presiding officer shall, upon his or her own initiative or upon request by any party, waive the application of any rule in this chapter upon reasonable notice to all affected persons if he or she determines that such waiver:

1. (a) Would not violate any applicable statutory or constitutional requirement;
2. (b) Would not unduly prejudice any party; and
3. (c) Would be more likely to promote the fair, accurate, and efficient resolution of an issue pending before the council than would adherence to the rule.
