- (a) The board shall consider all petitions for rulemaking and proceed pursuant to RSA 541-A:4.
- (b) The board shall request additional data or argument as necessary from the petitioner to clarify the petition.
- (c) If the data or argument fails to support the petition, the board shall state the reason therefore in a letter to the petitioner.
- (d) Denial of a petition shall be final and the person filing such petition, or any other interested person, shall not be entitled to request an adjudicative proceeding under this chapter.
- (e) If the data or argument supports the petition, the board shall commence rulemaking proceedings as provided in RSA 541-A:3 except in instances where there is a valid reason for denial such as, but not limited to, lack of rulemaking authority.
