1. (a) A request for a hearing may be made by any person who received a notice of violation, cease and desist order or stop sale, use or removal order.

2. (b) A request for a hearing shall be made by petitioning the department as follows:

   1. (1) In writing;
   2. (2) Including a plain statement describing the reasons for the hearing;
   3. (3) Be received by the department within 21 days of the date of the department's notice of violation or order, except in the case of a cease and desist order, which shall be received within 10 days of issuance of that order; and
   4. (4) In the case of a stop sale, use or removal order which shall be received within 4 days of issuance of that order.
3. (c) In cases where a registration, license or permit has been suspended pursuant to RSA 541-A:30, III, no request for a hearing before the department shall be required.
