Upon finding noncompliance with Agr 1700 or RSA 437, the department shall determine which sanctions pursuant to RSA 437:10 to impose by considering the:

1. (a) Severity of the offense;
2. (b) Licensee’s history of misconduct;
3. (c) Licensee’s acknowledgment of their wrongdoing;
4. (d) Licensee’s willingness to cooperate with the department’s investigation;
5. (e) Purpose of the rule or statute violated;
6. (f) Potential harm to public health and safety; and

7. (g) Nature and extent of the enforcement activities required of the department as a result of the offense.
