1. (a) An individual or entity who, without good cause as described in (b) below fails to reply to a notice of administrative fine by the date specified in the notice shall be subject to the following:

   1. (1) An administrative fine of $50.00 in addition to the fine specified by the notice;
   2. (2) If holding a license or certificate issued by the division, a 15-day suspension of the license or certificate; and
   3. (3) Referred to the New Hampshire attorney general for further action.

2. (b) Good cause for an individual's failure to reply to a notice of administrative fine by the date specified in the notice shall be:

   1. (1) Illness requiring a physician's care;
   2. (2) Involvement in a motor vehicle, industrial, or home accident;
   3. (3) Illness of a dependent requiring the personal care of the individual claiming the excuse;

   4. (4) Death of any of the following family members:

      1. a. Spouse;
      2. b. Civil union partner;
      3. c. Natural, foster or step child;
      4. d. Parent, step parent or parent-in-law;
      5. e. Sibling or step-sibling;
      6. f. Sister-in-law or brother-in-law;
      7. g. Daughter-in-law or son-in-law; or
      8. h. Grandparent; or
   5. (5) Death of a legal guardian.
3. (c) Any individual or entity subject to the penalties in (a) above shall have the right to challenge them through an adjudicative hearing pursuant to Agr 200.
