The commissioner shall deny the application for an initial or renewed device license if:

1. (a) The applicant has:

   1. (1) Made a willful misrepresentation or falsification on the application form;
   2. (2) Made a material omission on the application form;
   3. (3) Failed to pay any charge, fee, administrative fine or civil or criminal penalty for a violation of Agr 1400 or RSA 438 which is due to the commissioner or to a court arising out of proceedings brought by the division; or
   4. (4) Failed to comply with an order or finding by the commissioner; or
2. (b) The device intended to be licensed does not comply with the accuracy requirements for such devices, as determined by a division inspector.
