1. (a) Personnel identified as the agency’s representative in the proceeding shall be responsible for presenting the agency’s case, whether or not he or she appears as a witness.

2. (b) If not identified as the agency’s representative in the proceeding, agency staff shall have no role in the hearing unless:

   1. (1) Designated as the presiding officer;
   2. (2) Assigned to render clerical or administrative support in connection with the proceeding; or
   3. (3) Called as a witness.
3. (c) Unless called as a witness, granted intervenor status or a party to a dispute, a complainant shall have no role in a disciplinary or enforcement proceeding.
