The presiding officer, upon the motion of any party or intervenor or on his or her own initiative, shall upon prior notice to affected persons suspend or waive any requirement or limitation imposed by this chapter when the suspension or waiver:

1. (a) Appears to be lawful; and
2. (b) Is more likely to promote the just, accurate and efficient resolution of the pending dispute than would adherence to a particular rule or procedure.
