Any person having a dispute with the committee shall be entitled to a hearing of the dispute if:

1. (a) The legal rights, duties or privileges of that person will be determined in the course of deciding the outcome of the dispute; and
2. (b) Constitutional, statutory or case law requires the committee to hold a hearing before determination of those rights, duties or privileges.
