Nothing in this subdivision shall be construed to prevent or affect the following persons from evaluating septic systems:

1. I. A person who is employed by a governmental entity if the inspection is within official duties and responsibilities.
2. II. A septic system designer holding a current valid permit issued under RSA 485-A:35.
