The department shall work in collaboration with the advisory council established under RSA 126-A:96 to adopt rules pursuant to RSA 541-A, and prior to the department adopting any proposed rule, the department shall provide the council an opportunity to hold a roll call vote in support or opposition to any final proposed rule adopted pursuant to RSA 541-A, necessary to implement and maintain the program including:

1. I. The criteria for registration by dispensers and prescribers.
2. II. The criteria for a waiver pursuant to RSA 126-A:91, VIII for dispensers with limited electronic access to the program.
3. III. The criteria for reviewing the prescribing and dispensing information collected by the program.
4. IV. The criteria for reporting matters to the applicable health care regulatory board for further investigation.
5. V. The criteria for notifying practitioners of individuals that are engaged in obtaining controlled substances from multiple practitioners or dispensers.
6. VI. Content and format of all forms required under this subdivision.
