N.D. Cent. Code § 27-20.4-08 (2025)
1. A child alleged to be delinquent may be detained only in: a. A licensed foster home or a home approved by the court; b. A facility operated by a licensed child welfare agency; or c. A detention home or center for delinquent children which is under the direction or supervision of the court or other public authority or of a private agency approved by the court or any other suitable place or facility, including a medical facility for the treatment of mental illness, alcoholism, or drug addiction, designated by the court.
2. A child alleged or adjudicated delinquent, who has not reached the age of eighteen, may not be held in an adult jail or correctional facility, adult lockup, or court holding facility.
