1. 1. Licensees shall implement policies and procedures to assure incidents of alleged abuse, neglect, exploitation, and restraints:

1. a. Are reported to the governing body, chief executive officer or designee of the licensee, authorized representative, advocate, and the protection and advocacy project;

2. b. Are thoroughly investigated, the findings reported to the governing body, chief executive officer or designee of the licensee, authorized representative, advocate, and the protection and advocacy project and that the report and the action taken are recorded in writing and retained for three years; and

3. c. Are immediately reported to the department.

2. 2. Incidents resulting in injury to the staff or an eligible individual, requiring medical attention, hospitalization, endangering life, or result in a permanent disability must be recorded and reported to the governing body, chief executive officer or designee of the licensee, and to the department immediately, and as soon thereafter as possible to the authorized representative or advocate.
