75-03-40-02. Effect of license.
1. A facility license shall state the effective date. A license is effective for a maximum period of two years. A facility license is nontransferable and is valid only on the premises and for the number of residents indicated on the license.
2. For a licensed facility that changes its ownership or for a provisionally licensed facility upon issuance of an unrestricted license: a. The initial period of licensure is one year; and b. The licensing period thereafter may be renewed for a two-year period if the facility successfully remains in compliance with all licensing rules and requirements.
3. The department may issue a license without inspecting a facility's buildings, grounds, and equipment if the department finds: a. The facility was inspected and complied with the provisions of this chapter and North Dakota Century Code chapter 50-11 regarding buildings, grounds, and equipment in the preceding year; and b. The facility is otherwise eligible to receive a license.
