69-09-04-05. Acquisition of right of way - Notice of intent.

Persons intending to acquire operating railroad right of way under North Dakota Century Code section 49-09-10.2 shall notify the commission and provide it with the information specified by state law at least thirty days prior to the earlier of:

1. The proposed acquisition date; or

2. The filing of related notices with the interstate commerce commission.
