N.D. Admin. Code § 33.1-24-03-68
An eligible academic entity must provide training to all individuals working in a laboratory at the eligible academic entity, as follows:
1. Training for laboratory workers and students must be commensurate with their duties so they understand the requirements in sections 33.1-24-03-60 through 33.1-24-03-77 and can implement them.
2. An eligible academic entity can provide training for laboratory workers and students in a variety of ways, including: a. Instruction by the professor or laboratory manager before or during an experiment; b. Formal classroom training; c. Electronic or written training, or both; d. On-the-job training; or e. Written or oral examinations.
3. An eligible academic entity that is a large quantity generator must maintain documentation for the durations specified in subsection 5 of section 33.1-24-05-07 demonstrating training for all laboratory workers that is sufficient to determine whether laboratory workers have been trained. Examples of documentation demonstrating training can include the following: a. Sign-in or attendance sheets for training sessions, or both; b. Syllabus for training sessions; c. Certificate of training completion; or d. Test results.
4. A trained professional must: a. Accompany the transfer of unwanted material and hazardous waste when the unwanted material and hazardous waste is removed from the laboratory; and b. Make the hazardous waste determination, pursuant to section 33.1-24-03-02, for unwanted material.
