N.D. Admin. Code § 33.1-13-01-07
1. An owner and operator, and any previous owners and operators, must maintain records demonstrating compliance with all applicable requirements of sections 33.1-13-01-02 and 33.1-13-01-05 relating to those records: a. All written performance claims pertaining to any release detection system used, and the manner in which these claims have been justified or tested by the equipment manufacturer must be maintained for three years from the date of installation; b. The results of any sampling, testing, or monitoring must be maintained for at least three years; c. Written documentation of all calibration, maintenance, and repair of release detection equipment permanently located onsite must be maintained for at least three years after completion. Any schedules of required calibration and maintenance provided by the release detection equipment manufacturer must be retained for three years from the date of installation; d. Records in accordance with section 33.1-13-01-08 that can demonstrate compliance with closure requirements; and e. The results of the excavation zone assessment required in section 33.1-13-01-09 must be maintained for at least three years after completion of permanent closure or change in service.
2. Records shall be maintained: a. At the aboveground storage tank system location and immediately available for inspection by the department; or b. At a readily available alternative site and be provided for inspection to the department upon request.
If records cannot be retained as described in subdivisions a and b, the records must be provided to the department.
