A preliminary inquiry decision shall be made by:

1. (1) The full Commission if the complaint is received from one of the following:

   1. (a) any member of the Commission;
   2. (b) a duly constituted panel of the Commission; or
   3. (c) Commission staff.

2. (2) A Commission panel if the complaint is received from one of the following:

   1. (a) a local, state or federal agency referral; or
   2. (b) a third-party complainant.
