1. (a) The presumptive civil penalty for engaging in the practice of barbering with a registered barber certificate that has expired for more than a six month duration:

   1. (1) 1st offense $100.00
   2. (2) 2nd offense $150.00
   3. (3) 3rd offense $200.00

2. (b) The presumptive civil penalty for a barber shop manager allowing an individual to engage in the practice of barbering with a registered barber certificate that has expired for more than a six month duration:

   1. (1) 1st offense $100.00
   2. (2) 2nd offense $150.00
   3. (3) 3rd offense $200.00
