1. (a) The presumptive civil penalty for operating a barber shop without first filing an application for a barber shop license, obtaining an inspection, and obtaining a shop permit:

   1. (1) 1st offense $200.00
   2. (2) 2nd offense $300.00
   3. (3) 3rd offense $500.00

2. (b) The presumptive civil penalty for operating a barber shop with an expired permit:

   1. (1) 1st offense $150.00
   2. (2) 2nd offense $300.00
   3. (3) 3rd offense $500.00
