The Department shall take further action to obtain confirmation as to whether information previously held confidential continues to meet the statutory criteria for protection from premature disclosure when:

1. (1) A principal and the principal's authorized government official submit conflicting responses regarding the status of information protected from premature disclosure; or
2. (2) Either the principal or authorized government official fails to file a response pursuant to Rule .0528 of this Chapter.
