A custodian shall retain a session record longer than the time period identified by Rule .2007 of this Section:

1. (1) if directed by the Department to retain the records pursuant to an investigation authorized by G.S. 10B-60; or
2. (2) upon receipt of a legal notification requiring the custodian, notary public, or principal to preserve the record.
