1. (a) An instructor applicant who asserts exemption from the fee pursuant to G.S. 10B-14(c) shall certify on the instructor certification or recertification application form that as of the date of application, the applicant is currently employed as:

   1. (1) a register of deeds;
   2. (2) a clerk of court; or
   3. (3) an employee of the Department and is authorized by the Secretary to teach notary courses as set forth in G.S. 10B-14(c).
2. (b) The Department shall refuse to administer the notary public instructor certification exam to an applicant who has failed to pay the fee required for certification or recertification as a notary instructor before the exam date.
