Licensed game bird propagators that raise and release pen-raised quail on his or her property for dog training shall be authorized to use quail call-pen traps to recover released quail, subject to the following requirements:

1. (1) All traps shall be marked with an attached, weather-resistant permanent tag that includes the propagator's name and address written legibly on it;
2. (2) No trap shall be located within 100 yards of any boundary of the property; and
3. (3) No trapped, unbanded quail shall be retained.
