1. (a) Declaratory rulings pursuant to G.S. 150B‑4 shall be issued by the Department only:

   1. (1) as to the validity of a rule adopted by the Department; or

   2. (2) as to the applicability to a given state of facts of:

      1. (A) a statute administered by the Department,
      2. (B) a rule adopted by the Department, or
      3. (C) an order issued by the Department.
2. (b) A declaratory ruling shall not be issued on a matter requiring an evidentiary proceeding.
