Preservation or conservation agreements entered into by the state for sites or landscapes containing or encompassing archaeological materials shall also address the following:

1. (1) procedures, limitations, and processes for permitting the collection and analysis of cultural materials or artifacts from the ground surface of the sites;
2. (2) permitting the excavation and analysis of all or a portion of the archaeological deposits at the sites;
3. (3) determining curatorial and possession responsibilities and rights for all materials recovered through surface collection or excavation.
