R6‑39 SAFETY PROGRAM

1. (a) Each utility shall adopt and execute a safety program, fitted to the size and type of its operations. As a minimum, the safety program should:

   1. (1) Require employees to use suitable tools and equipment in order that they may perform their work in a safe manner.
   2. (2) Instruct employees in safe methods of performing their work.
   3. (3) Instruct employees who, in the course of their work, are subject to the hazard of electrical shock, asphyxiation or drowning, in accepted methods of artificial respiration.
2. (b) The minimum federal safety standards and the corrosion control standards pertaining to gas pipeline safety and the transportation of natural gas as adopted in 49 CFR, Part 192 and 49 CFR, Part 192 Subpart I, as are in effect on November 15, 1971, and amendments thereto, are adopted and shall be applicable to all natural gas facilities under the jurisdiction of the Commission, except as to those requirements of North Carolina law which exceed or are more stringent than the standards set forth in the above-mentioned federal enactment, and further with the exception of any subsequent modification or amendment to the North Carolina safety standards.
3. (c) The Federal Safety Standards pertaining to liquefied natural gas facilities, as adopted in 49 CFR, Part 193, and as were in effect on July 15, 1980, and all subsequent amendments thereto, are adopted and shall be applicable to all liquefied natural gas facilities under the jurisdiction of the Commission.
4. (d) Control of Drug Use. - The Federal Safety Standards pertaining to the control of drug use in natural gas, liquefied natural gas, and hazardous liquid pipeline operations as adopted in 49 CFR, Part 199, and as were in effect on September 19, 1989, and all subsequent amendments thereto, are adopted and shall be applicable to all facilities under the jurisdiction of the Commission.

5. (e) The Federal Safety Standards pertaining to Grants for State Pipeline Safety Programs; State Adoption of One Call Damage Prevention Program as adopted in 49 CFR, Part 198, and as was in effect on September 20, 1990, and all subsequent amendments thereto, are adopted and shall be applicable to all natural gas facilities under the jurisdiction of the Commission.
