- (1) A person may not begin construction of a high-hazard dam as determined under 85-15-209 without first obtaining a construction permit from the department.
(2) An application for a construction permit must be submitted to the department and must contain:
- (a) plans and specifications for the proposed construction, prepared by or under the direction of an engineer experienced in dam design and construction; and
- (b) other data and information required by the department.
(3) Within 60 calendar days after receipt of the application and any additional information requested by the department, the department shall:
- (a) issue a construction permit or deny the application, as filed; or
- (b) issue a construction permit upon terms, conditions, or modifications the department considers appropriate.
