1. (1) A person who violates this chapter or a rule or order issued under this chapter is subject to a civil penalty not to exceed $5,000 for each violation. For purposes of this section, each day of a violation is a separate violation.
2. (2) The department shall initiate civil proceedings in district court to recover a penalty under subsection (1).
3. (3) Civil penalties collected under this section must be deposited in the general fund.
4. (4) An action under this section does not bar enforcement of this chapter or of rules or orders issued under it by injunction or other appropriate remedy.
