No publication need be made as provided in 46-23-302, 46-23-303, and 46-23-304 in the following cases:

1. (1) when there is imminent danger of the death of the person convicted or imprisoned;
2. (2) when the term of imprisonment of the applicant is within 10 days of its expiration.
