Mont. Code Ann. § 45-8-376 – Enforcement and penalties

(1) The attorney general is authorized to enforce the provisions of 45-8-371 and 45-8-377.
(2) A person who brings a negligent marketing claim in violation of 45-8-374 is subject to:
1. (a) dismissal of the claim; and
2. (b) payment of reasonable attorney fees and costs incurred by a party defending the claim.
