An insurer delivering a notice or a document by electronic means shall take appropriate and necessary measures reasonably calculated to ensure that the system for furnishing the notices or documents:

1. (1) results in actual receipt of transmitted information; and
2. (2) protects the confidentiality of personal information as defined in 33-19-104.
