For purposes of this part, the following definitions shall apply:

1. (1) "Board member" means a member of the board of directors of the institution.

2. (2) "Cease and desist order which has become final" and "order which has become final" mean a cease and desist order or an order issued by the director with the consent of the institution or the board member, officer, or other person concerned, with respect to which:

   1. (a) a timely petition for review of the action of the director has not been filed in a district court as specified in 32-1-908(2); or
   2. (b) the action of the court in which a petition for review has been filed is not subject to further review by the courts of the state.
3. (3) "Director" means the director of the department of administration.
4. (4) "Institution" means a commercial bank, savings bank, trust company, or investment company chartered under Title 32, chapter 1.
5. (5) "Violation" includes without limitation any action, alone or with others, causing, counseling, aiding, or abetting a violation.
