If multiple requests for repatriation of human skeletal remains or funerary objects occur and the appropriate claimant cannot be determined, the board shall provide for the appropriate care and handling of the human skeletal remains or funerary objects until:

1. (1) the requesting parties agree upon the disposition;
2. (2) the dispute is resolved by the board pursuant to 22-3-916; or
3. (3) the issue is finally resolved in a state court of competent jurisdiction.
