Subject to 19-3-402, 19-3-403, 19-3-412, and 19-3-413, eligible employees under the system who are not covered by a separate retirement system under this title include the following:

1. (1) any employee of the state of Montana, its university system or any of the colleges, schools, components, or units of the university system; and
2. (2) any employee of a contracting employer eligible to participate under the contract between the board and the contracting employer under 19-3-201.
