1. (1) A dispute resolution process subject to this subchapter:

   1. (a) is not a contested case as defined in 2-4-102, MCA;
   2. (b) is not a proceeding before the commissioner; and
   3. (c) is not subject to the Montana Administrative Procedure Act, Title 2, chapter 4, MCA.

2. (2) The independent dispute resolution process is exhausted upon issuance of the independent reviewer's final decision. A final decision:

   1. (a) is not appealable;

   2. (b) does not limit or create any private rights or remedies for either party;

      and

   3. (c) does not preclude a party from pursuing any available remedies in a court of competent jurisdiction.
