44.3.2802 PAID SIGNATURE GATHERERS BADGE REQUIREMENTS

1. (1) When a paid signature gatherer, as defined in 13-27-112, MCA, approaches anyone about signing a petition, they must wear a badge.

   1. (a) Format and Size of Badge:

      1. (i) The badge must be at least four inches by three inches in size.
      2. (ii) The words on the badge must be in English.
      3. (iii) The first line must contain the paid signature gatherer’s full first name and last initial. The second line must state “From” followed by the paid signature gatherer’s legal state of residence. The third line must state “Paid Signature Gatherer.”

   2. (b) Font on the Badge:

      1. (i) The words must be visible and easy to read on the front of the badge, in either Helvetica or Arial font.
      2. (ii) The words must be in the largest font size possible to fit within the full space on the badge.

   3. (c) Visibility of Badge:

      1. (i) A paid signature gatherer must wear the badge on the outside of all garments, with the badge font lettering facing toward each and every petition signer.
      2. (ii) A paid signature gatherer must not obstruct the visibility of the badge’s contents.
2. (2) Upon proof that petition sheets were gathered by a paid signature gatherer not wearing a badge containing the proper information or by a paid signature gatherer failing to conform to these rules, the Secretary of State shall not count the applicable signatures.
