1. (1) To provide guidance and certainty in identifying who is a public official as defined in 5-7-102 (16) , MCA, and an elected state official as defined in 5-7-102 (7) , MCA, the following are deemed to be an elected public official acting in his/her official capacity for state government:

   1. (a) the governor;
   2. (b) the lieutenant governor;
   3. (c) the secretary of state;
   4. (d) the attorney general;
   5. (e) the state auditor;
   6. (f) the superintendent of public instruction;
   7. (g) public service commissioners;
   8. (h) justices of the supreme court;
   9. (i) district court judges;
   10. (j) the clerk of the supreme court; and
   11. (k) legislators.
