1. (1) If, after an inspection, the department determines a violation of these rules may have occurred, then it shall issue a notice of violation to the owner of the anhydrous ammonia facility.

2. (2) The notice of violation shall include:

   1. (a) the nature and evidence of the violation;
   2. (b) date and place of hearing for review of the violation(s) .
3. (3) If, following the hearing, the department determines a violation occurred, then it may certify its findings and conclusions to a prosecuting attorney for prosecution of the violation.
